NOTICE OF INTENTION TO EXTINGUISH THE PUBLIC RIGHT OF WAY OVER BARBERSTOWN LANE NORTH, Co. DUBLIN (FINGAL COUNTY COUNCIL)

Notice is hereby given that Fingal County Council in pursuance of its functions under Section 73 of the Roads Act, 1993 proposes as Local Authority for the administrative area of the County of Fingal to make an order that the public right of way in the schedule hereunder shall be extinguished. 

Schedule:  The public right of way to be extinguished at Barberstown Lane North, as shown on Drawing No ROW-2024-001.

The purpose of this extinguishment of right of way is to facilitate the construction of the Ongar-Barnhill Road, which will provide approximately 1.8km of road, footpath and cycle facilities from the Ongar Roundabout to Barberstown Lane South and includes the provision of a new road crossing of the Dunboyne railway line. 

A copy of Drawing Reference Number ROW-2024-001 indicating the public right of way to be extinguished may be inspected from Monday to Friday between 9am and 4.30pm at the following locations:

  • Fingal County Council, County Hall, Main Street, Swords, Co. Dublin
  • Fingal County Council, Civic Offices, Grove Road, Dublin 15

Objections or submissions on the proposed Extinguishment of Right of Way at Barberstown Lane North may be may be made online through this Consultation Portal from Wednesday 13th March 2024 to Monday 29th April 2024or alternatively in writing to:

to arrive no later than  5pm Monday 29th April 2024.

Persons making such objections or representations may at the same time make a request in writing to state their case at an Oral Hearing conducted by a person appointed by Fingal County Council for that purpose.

All comments, including the names of those making comments, which are submitted to the Council regarding this Proposed Extinguishment of Right of Way will form part of the statutory report to be presented to the monthly meeting of Fingal County Council.

Accordingly the statutory report will list the persons or bodies who made submissions or observations with respect to the proposed Extinguishment of Right of Way in accordance with the regulations of the Roads Act 1993 and Road Traffic Act 1994. The submissions will also be included in the minutes of that meeting and consequently will appear on the Council’s Website.

By making a submission the name of individual or bodies will appear on the statutory report and minutes of the meeting
