What happens next?
ANCA will consider all submissions and observations received during this consultation prior to making a Regulatory Decision. When we make a Regulatory Decision, we will prepare a final report with our reasons for making one.
Please note that this is a separate process from the submissions to the Planning Authority on the planning application.
Can I appeal a Regulatory Decision of the competent authority?
ANCA’s Regulatory Decision must be incorporated into the planning authority’s decision on the application regardless of whether the planning authority’s decision is to refuse or to grant the application.
The decision of the Planning Authority may be appealed to An Bord Pleanála by 'any person who made submissions or observations in writing in relation to the planning application to the planning authority' includes any person who made submissions or observations to ANCA in relation to the draft regulatory decision or related report in this consultation .
The receipt of submission received is an important document. Please retain this as evidence of your submission.
