Notification of update on extinguishment of Right of way at Holywell View

In order to affect the extinguishment of right of way requested by a number of residents in Holywell View, the statutory procedure in accordance with Section 73, Roads Act 1993 was initiated and notice of the intention to extinguish the public right of way was advertised on March 23rd, 2021. The public consultation process was open from Tuesday 23rd March 2021 to Friday 23rd April 2021.

A report on the outcome of the public consultation was discussed at the meeting of the Balbriggan/Rush-Lusk/Swords Area Committee (Services A – Operational Matters and Water Services) held on Thursday 10th June 2021. 

Outcomes

The decision regarding the Extinguishment of Public Right of Way is a reserved function and at the Meeting of Fingal County Council on 12th July 2021 the Elected Members agreed to proceed with the extinguishment and a gate is to be erected on site to restrict pedestrian access at the location identified.

In accordance with subsection (1) (a) of the 1993 Act, the Council is obliged to notify in writing any person who made written objections or representations to it in relation to such extinguishment.
